Why does that matter for psychedelic biotech? Because GWPH proved that a controlled-substance-related drug can move through the normal pharmaceutical pathway: Clinical trials > FDA approval > DEA scheduling action > prescription commercialization > big pharma acquisition. Epidiolex was a purified CBD prescription medicine derived from cannabis. Cannabis itself did not need to become federally legal for Epidiolex to become an FDA-approved prescription drug. The government did not legalize the whole plant. It approved and scheduled a specific medical product. That is the key point for DFTX, CMPS, and ATAI. If Definium’s DT120, Compass’s COMP360, or ATAI/AtaiBeckley’s pipeline drugs make it through FDA review, the government does not need to broadly legalize LSD, psilocybin, DMT, or other psychedelics. It can approve and schedule the specific prescription drug product, for the specific indication, under specific medical controls. That is the same logic Epidiolex followed. And the valuation precedent is real. Jazz paid roughly $7.2B for GWPH. At the time, Epidiolex had already exceeded $500M in annual sales and was viewed as having blockbuster potential. By 2025, Epidiolex/Epidyolex had reached about $1.1B in annual net sales. That is why the psychedelic NDA pathway is so important. DFTX is not trying to legalize LSD broadly. It is trying to turn DT120 into an FDA-approved psychiatric medicine for MDD, GAD, and potentially PTSD. CMPS is not trying to legalize mushrooms. It is trying to turn COMP360 into an FDA-approved treatment for TRD, with PTSD expansion potential. ATAI is earlier, but the same logic could apply if BPL-003, VLS-01, or EMP-01 succeeds. If these companies can create approved CNS drug franchises with $1B, $2B, $3B+ in peak annual sales, then the GWPH/Jazz precedent shows why multi-billion-dollar valuations are possible. The government does not need to legalize the entire substance to approve and reschedule a specific prescription drug. That is the part of the story I think the market is still digesting.
